A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of health shall establish and convene a working group to conduct a study on whether establishing a new category of professional licensure for assistant physicians would help address the physician shortage in the State.

     (b)  The working group's study shall include but not be limited to:

     (1)  Researching other states' laws that have created a new category of licensed assistant physicians;

     (2)  Making recommendations regarding educational, training, and licensure requirements for assistant physicians that would ensure patient safety in the State;

     (3)  Considering whether the Hawaii medical board has statutory authority to oversee a licensing program for assistant physicians;

     (4)  Researching the potential impacts on the physician shortage in the State, if a licensing program for assistant physicians was established; and

     (5)  Any other concerns relating to assistant physicians the working group deems relevant.

     (c)  The director of health, or the director's designee shall chair the working group.  The working group shall include the following members, or their designees:

     (1)  The director of commerce and consumer affairs;

     (2)  The chairperson of the Hawaii medical board;

     (3)  The dean of the John A. Burns school of medicine; and

     (4)  Others as recommended by the working group.

     (d)  The working group shall be exempt from chapter 92, Hawaii Revised Statutes.

     (e)  The members of the working group shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (f)  No member of the working group shall be subject to chapter 84, Hawaii Revised Statutes, solely because of the member's participation in the working group.

     (g)  The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     (h)  The working group shall be dissolved on June 30, 2021.

     SECTION 2.  This Act shall take effect on July 1, 2050.
