A BILL FOR AN ACT

 

 

relating to contractors.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that contractors in the State can obtain three types of licenses from the contractors license board:

     (1)  General engineering contractor license;

     (2)  General building contractor license; and

     (3)  Specialty contractor license.

     The legislature further finds that the contractors license board may grant general engineering and general building licensees with additional specialty classifications.  The board has created as many as seventeen specialty classifications for the general engineering contractor license, and as many as ten specialty classifications for the general building contractor license.  General engineering and general building licensees are not required to undergo additional examination nor pay additional license fees to receive the specialty classifications, while specialty contractor licensees must take individual examinations and pay individual licensing fees for each classification.

     The purpose of this Act is to specify that general engineering contractors and general building contractors shall require additional examination and additional fees prior to the issuance of additional specialty classifications.

     SECTION 2.  Section 444-8, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  A licensee may make application for classification and be classified in more than one classification if the licensee meets the qualifications prescribed by the board for such additional classification or classifications[.]; provided that no specialty classifications shall be issued to general engineering licensees or general building licensees without additional examination or payment of additional fees for each specialty classification applied for.  For qualifying or classifying in additional classifications, the licensee shall pay the appropriate application fee [but shall not be required to pay any additional license fee]."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
