A BILL FOR AN ACT

 

 

RELATING TO OCEAN RESOURCES.

                         

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that, over time, recreational and subsistence activities, including fishing, gathering, and leisure tours, have intersected in such a manner that necessitates state review and oversight of coastal areas.  The establishment of a task force to assist the department of land and natural resources in developing rules would ensure greater protection of the State's ocean resources by allowing interested parties to engage in meaningful discourse.

     Accordingly, the purpose of this Act is to:

     (1)  Establish a task force to assist the department of land and natural resources in developing rules applicable to all coastal areas and nearshore waters; and

     (2)  Appropriate funds for the department of land and natural resources to conduct public outreach meetings to adopt rules applicable to all coastal areas and nearshore waters.

     SECTION 2.  (a)  The department of land and natural resources shall convene a task force to assist the department in developing rules that regulate fishing, gathering, leisure, and other activities and that are applicable to all coastal areas and nearshore waters of the State.

     (b)  The task force shall comprise:

     (1)  Two members appointed by the governor;

     (2)  Two members appointed by the president of the senate;

     (3)  Two members appointed by the speaker of the house of representatives; and

     (4)  One member to be selected by the members appointed pursuant to paragraphs (1), (2), and (3), from a list of three candidates provided by the office of Hawaiian affairs.

     (c)  The members of the task force shall elect a chairperson from among its membership.  Members of the task force shall receive no compensation for their service on the task force, but shall be reimbursed for reasonable expenses, including travel expenses, incurred as a consequence of serving on the task force.  No member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the task force.

     (d)  In performing its duties pursuant to this section, the task force shall:

     (1)  Consult with persons who have expertise in host culture konohiki practices; and

     (2)  Examine empirical and scientific data compiled by credible academic and scientific sources.

     (e)  The task force shall submit annual written reports of its findings and recommendations, including any proposed rules and legislation, to the legislature no later than twenty days prior to the convening of the regular sessions of 2015, 2016, and 2017.

     (f)  The task force shall cease to exist on June 30, 2017.

     SECTION 3.  The department of land and natural resources shall not implement any rules under title 12, Hawaii Revised Statutes, relating to fishing, gathering, or ocean resources within the coastal areas and nearshore waters of the island of Niihau prior to the task force's submittal of its final report pursuant to section 2 of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2014-2015 for the department of land and natural resources, in consultation with the executive director of the aha moku advisory committee, to conduct public outreach meetings on each island for the purpose of adopting rules regarding statewide coastal management, pursuant to chapter 91, Hawaii Revised Statutes, applicable to all coastal areas and nearshore waters. 

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2014.

Description:

Establishes a task force to assist the DLNR in developing rules that regulate activities within and that are applicable to all coastal areas and nearshore waters.  Requires reports to the Legislature in 2015, 2016, and 2017.  Prohibits DLNR from adopting any such rules affecting coastal areas and nearshore waters of Niihau until the task force submits a final report.  Appropriates funds for the DLNR to conduct public outreach meetings to adopt rules applicable to all coastal areas and nearshore waters.  Effective July 1, 2014.  (HB709 HD2)
