A BILL FOR AN ACT

 

 

RELATING TO DAM SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§205‑    Dams and reservoirs.  Dams and related reservoir areas designated as important agricultural lands that are used primarily for:

     (1)  Cultivation of crops, including crops for bioenergy, flowers, vegetables, foliage, fruits, forage, and timber;

     (2)  Game and fish propagation; or

     (3)  Raising of livestock, including poultry, bees, fish, or other animal or aquatic life that are propagated for economic use,

shall be eligible for inclusion in the total acreage calculation for important agricultural lands and shall qualify for incentives pursuant to section 205-46; provided that dams and reservoirs classified as important agricultural lands shall not be included in the total acreage calculation for a petition for declaratory order to designate important agricultural lands in combination with the reclassification of agricultural lands to the rural, urban, or conservation district."

     SECTION 2.  (a)  There is established the dam safety task force, to be placed within the department of land and natural resources for administrative purposes only.

     (b)  The dam safety task force shall consist of the following members:

     (1)  The chairperson of the board of land and natural resources or the chairperson's designee, who shall serve as the chairperson of the task force;

     (2)  The chairperson of the board of agriculture or the chairperson's designee;

     (3)  The attorney general or the attorney general's designee;

     (4)  The deputy director for water resource management of the department of land and natural resources or the deputy director's designee;

     (5)  Upon request, a member of the Hawaii Cattlemen's Council, selected by the Council; provided that the Council accepts the request;

     (6)  Upon request, a representative of the Hawaii Farm Bureau Federation, selected by the Federation; provided that the Federation accepts the request;

     (7)  Upon request, an owner of a parcel of agricultural land in the State greater than     acres that contains at least one dam, to be selected by the chairperson of the task force; provided that the owner accepts the request; and

     (8)  Upon request, five persons with specialized knowledge and experience in water resource management and engineering, to be selected by the chairperson of the task force; provided that the individuals accept the request.

     (c)  The dam safety task force shall review applicable state laws, administrative rules, and county ordinances and recommend actions to be taken by the engineering division of the department of land and natural resources in its administration of the Hawaii dam safety program.

     (d)  The members of the dam safety task force shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (e)  The dam safety task force shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2012.

     (f)  The dam safety task force shall cease to exist on June 30, 2012.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2030.
