HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THAT THE CORRECTIONAL JUSTICE TASK FORCE CONTINUE ITS STUDY OF EFFECTIVE INCARCERATION POLICIES TO REDUCE THE DETAINEE AND INMATE POPULATION WHILE PRESERVING PUBLIC SAFETY, LOWER RECIDIVISM, AND IMPROVE HAWAII'S CORRECTIONAL SYSTEM.

 

 

 


     WHEREAS, the Legislature finds that long prison sentences and an increase in offender recidivism rates have contributed to a spike in the United States' prison population despite the decrease of crime in the past 20 years; and

 

     WHEREAS, the increase in prisoners has led to inflated government spending on corrections, rising operating costs of correctional facilities, and reduced funding for other essential government services; and

 

     WHEREAS, the Legislature finds that a collaborative approach by stakeholders using successful, research-based solutions would improve Hawaii's correctional system and ensure positive outcomes for prisoners and the community; and

 

     WHEREAS, the Correctional Justice Task Force created by House Concurrent Resolution No. 85, S.D. 1 (2016) and led by Hawaii Supreme Court Associate Justice Michael Wilson has provided meaningful discussion, expert guidance, and suggested improvements regarding Hawaii's incarceration policies, correctional system, and the design of future correctional facilities; and

 

WHEREAS, while the Correctional Justice Task Force is set to dissolve after 2017, the Legislature finds that the Task Force's efforts to improve Hawaii's correctional system are valuable to the State and should be continued; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the Senate concurring, that the Correctional Justice Task Force is requested to continue its study of effective incarceration policies to reduce the detainee and inmate population while preserving public safety, lower recidivism, and improve Hawaii's correctional system as specified in House Concurrent Resolution No. 85, S.D. 1 (2016); and

 

     BE IT FURTHER RESOLVED that the Correctional Justice Task Force shall remain the same as established by House Concurrent Resolution No. 85, S.D. 1 (2016); provided that any vacancies in membership shall be filled in the same manner as the original appointment; and

 

     BE IT FURTHER RESOLVED that members shall not receive compensation for their services, and no member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the Correctional Justice Task Force; and

 

     BE IT FURTHER RESOLVED that the Correctional Justice Task Force shall be exempt from chapter 92, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the Judiciary and the Department of Public Safety shall provide administrative support to the Correctional Justice Task Force; and

 

BE IT FURTHER RESOLVED that the Correctional Justice Task Force, with the assistance of the Legislative Reference Bureau, is requested to submit an additional report of its continued findings and recommendations, including any proposed legislation, that address reducing the State's detainee and inmate population while preserving public safety, lowering recidivism, and improving the correctional system to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and

 

BE IT FURTHER RESOLVED that, upon request of the Correctional Justice Task Force, the Legislative Reference Bureau shall assist in the preparation of its report; provided that, before September 1, 2018, the Task Force shall submit a draft to the Legislative Reference Bureau, including any other information and materials deemed necessary by the Bureau, for the preparation of the final report; and

 

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chief Justice, Administrator of the Judiciary's Adult Client Services Branch, Director of Public Safety, Chairperson of the Hawaii Paroling Authority, Chairperson of the Board of Trustees of the Office of Hawaiian Affairs, President of the University of Hawaii System, Director of the Legislative Reference Bureau, President of the Board of the Native Hawaiian Legal Corporation, Chairperson of the Holomua Puuhonua Committee, and Chairperson of the Correctional Justice Task Force.
