HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE HAWAII PUBLIC HOUSING AUTHORITY TO CARRY OUT ITS RESPONSIBILITIES UNDER SECTION 5 OF ACT 178, SESSION LAWS OF HAWAII 2006.

 

 

 


     WHEREAS, the Hawaii Public Housing Authority was established to provide affordable housing and shelter to Hawaii residents without discrimination; and

 

     WHEREAS, only with accurate and complete reporting and accounting can the Hawaii Public Housing Authority effectively carry out its mission and its responsibilities to other departments and agencies; and

 

     WHEREAS, Act 178, Session Laws of Hawaii 2006 (Act 178), was enacted in part to identify revenue-generating public trust lands and the amounts derived from those lands by requiring the Department of Land and Natural Resources, with the cooperation of the Department of Budget and Finance and any other state department or agency that uses or manages public lands, to annually provide an accounting of all receipts from lands described in section 5(f)of the Admission Act for the prior fiscal year; and

 

     WHEREAS, under section 5, the annual accounting must contain specific information with respect to each receipt, for example the total gross amount, the amount transferred to the Office of Hawaiian Affairs, and the parcel of land that generated the receipt; and

 

     WHEREAS, although the Hawaii Public Housing Authority is subject to Act 178, the Department of Land and Natural Resources has not received a revenue report from the Hawaii Public Housing Authority for fiscal years 2006-2007 and 2007-2008, and reported to the Legislature in 2008, that:

 

     "According to its [Hawaii Public Housing Authority's] Fiscal Office, the accounting system has been unreliable for the last several years, and is not capable of producing an accurate report.  They are in the process of reconstructing their books from scratch";

 

and

 

     WHEREAS, it is unclear whether the Hawaii Public Housing Authority has completed this process or has ever submitted a completed revenue report to the Department of Land and Natural Resources; and

 

     WHEREAS, the lack of readily-available and accurate information on the Hawaii Public Housing Authority's revenues and the resulting negative impact on the State’s full compliance with Act 178, raises serious concerns; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Hawaii Public Housing Authority is requested to carry out its accounting and reporting responsibilities under Section 5 of Act 178, Session Laws of Hawaii 2006; and

 

     BE IT FURTHER RESOLVED that the Hawaii Public Housing Authority is requested to submit a report of its progress in carrying out these responsibilities to the Legislature no later than 20 days prior to the convening of the Regular Session of 2012; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor, Director of Land and Natural Resources, Board of Directors of the Hawaii Public Housing Authority, and Chairperson of the Board of Trustees of the Office of Hawaiian Affairs.
