A BILL FOR AN ACT

 

 

RELATING TO ANIMALS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§711‑    Trapping feral cats by use of a trap.  (a)  A person commits the offense of trapping feral cats by use of a trap if the person uses a trap to catch a feral cat.

     (b)  Proof of ownership of the feral cat shall be an affirmative defense to prosecution under this section.

     (c)  Engagement in a humane endeavor is not a defense to prosecution under this section.

     (d)  For purposes of this section:

     "Feral cat" means a cat that has been abandoned as a pet or is found in or born to a colony of cats inhabiting public property.  The owner of a feral cat is unknown, is not immediately obvious upon visual observation of the animal, or if the contact information on an identification microchip imbedded under the cat's skin is outdated and the registered owner cannot be contacted.

     "Trap" means:

     (1)  A cage-like device having a spring loaded single door; or

     (2)  A leg-hold mechanism that wraps around the leg of the cat when the mechanism is activated.

     (e)  Trapping feral cats by use of a trap is a misdemeanor.

     §711‑    Sale of cat trap prohibited.  (a)  A person commits the offense of sale of a cat trap if the person sells or causes to be sold a trap to catch a cat.

     (b)  As used in this section, "trap" means:

     (1)  A cage-like device having a spring loaded single door; or

     (2)  A leg-hold mechanism that wraps around the leg of the cat when the mechanism is activated.

     (c)  The sale of a cat trap is a misdemeanor."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
