A BILL FOR AN ACT

 

 

relating to trans fat.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Trans fat; restricting availability at public schools.  (a)  For the purposes of this section:

     "Extended school day" means the school day, plus any additional time that a student spends on school grounds before or after the school day for the purpose of participating in a school-sanctioned activity or child care program.

     "Industrially produced trans fat" means vegetable shortening, margarine, or any type of partially hydrogenated vegetable oil that contains more than zero grams of trans fat per serving as labeled.

     "School food service establishment" means a place that regularly sells or serves a food or beverage item or school meals on a public school campus.

     "School meals" has the same meaning as set forth in section 302A-101.

     (b)  School food service establishments shall not:

     (1)  Make available to a student any food or beverage item that contains any amount of industrially produced trans fat; or

     (2)  Use food that contains any industrially produced trans fat in the preparation of any food or beverage item that is intended for consumption by a student.

     (c)  The prohibition described in subsection (b) applies to all food and beverage items made available to a student on school grounds during each school day and extended school day, including but not limited to school meals and food or beverage items made available to a student in a school cafeteria, school store, vending machine, or other food service entity existing upon school grounds.

     (d)  The prohibition described in subsection (b) does not apply to the following:

     (1)  Any food or beverage item that is made available to a student as part of a United States Department of Agriculture meal program;

     (2)  Any food or beverage item that is made available to a student as part of a fundraising effort conducted by one or more students, teachers, or parents; or

     (3)  Any food or beverage item that is donated to the school and intended to be given to a student for consumption off of school premises after the school day or extended school day.

     (e)  The department may adopt rules pursuant to chapter 91 as are necessary or desirable to carry out the purposes of this section."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for consulting services related to the implementation of this Act.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2013.
