A BILL FOR AN ACT

 

 

relating to accessibility.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 107, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§107-    Symbol of access.  Prior to January 1, 2018, the department of accounting and general services shall adopt rules pursuant to chapter 91 to require that all signage indicating access for persons with disabilities shall depict the symbol of access as defined in section 291-51 depicting a dynamic character leaning forward with a sense of movement.  The symbol of access shall be readily identifiable, simply designed with no secondary meaning, and provide for equivalent facilitation and accessibility as the international symbol of access.  The symbol of access shall be required for all buildings and structures constructed or substantially renovated or expanded, and all signs installed or replaced on or after January 1, 2018.  For purposes of this section, "international symbol of access" has the same meaning as in section 291-51."

     SECTION 2.  Chapter 291, part III, Hawaii Revised Statutes, is amended by amending its title to read as follows:

     "PART III.  PARKING FOR [DISABLED] PERSONS WITH DISABILITIES"

     SECTION 3.  Section 291-51, Hawaii Revised Statutes, is amended:

     1.  By adding a new definition to be appropriately inserted and to read as follows:

     ""Symbol of access" means the logo designed by the Accessible Icon Project that depicts a dynamic character leaning forward with a sense of movement."

     2.  By amending the definitions of "sign designating the parking space reserved for persons with disabilities" and "special license plate" to read as follows:

     ""Sign designating the parking space as reserved for persons with disabilities" means a sign which contains:

     (1)  The words, "Reserved Parking";

     (2)  The international symbol of access[;] or the symbol of access, as appropriate;

     (3)  Words indicating that the space is reserved for parking by persons with disabilities who have valid placards or special license plates; and

     (4)  The maximum fine for parking illegally in the space.

     "Special license plate" means a license plate that displays the international symbol of access[:] or symbol of access, as appropriate:

     (1)  In a color that contrasts to the background; and

     (2)  In the same size as the letters or numbers on the plate."

     SECTION 4.  Section 291-56, Hawaii Revised Statutes, is amended to read as follows:

     "§291-56  Rules.  The disability and communication access board shall adopt rules under chapter 91 to carry out the purposes of this part, including rules for:

     (1)  The issuance, renewal, confiscation, revocation, and suspension of removable windshield placards, temporary removable windshield placards, and special license plates;

     (2)  Decertification, reciprocity, and the replacement of placards and identification cards;

     (3)  The design of the placard, identification card, and special license plates; provided that any placard, identification card, and special license plate issued or renewed on or after January 1, 2018, shall contain the symbol of access in lieu of the international symbol of access;

     (4)  The establishment of transaction fees for placards;

     (5)  Signage and marking of parking spaces; provided that any signage and marking of parking spaces installed or replaced on or after January 1, 2018, shall contain the symbol of access in lieu of the international symbol of access;

     (6)  Reimbursement rates to the counties; and

     (7)  Penalties."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval.

Symbol of Access; Persons with Disabilities; Department of Accounting and General Services; Disability and Communication Access Board

 

Description:

Requires the department of accounting and general services to adopt rules to require the international symbol of access to be replaced with the symbol of access depicting a dynamic character leaning forward with a sense of movement.  Applies to new signage, buildings, and structures in place on or after January 1, 2018.  Requires the disability and communication access board to include the symbol of access in lieu of the international symbol of access on various items issued, renewed, installed, or replaced on or after January 1, 2018.  Defines symbol of access.
