A BILL FOR AN ACT

 

 

relatING to health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328J-    Sale of certain e-liquid containers prohibited.  (a)  Beginning October 1, 2024, it shall be unlawful for any person or business to sell, offer for sale, or introduce into commerce in the State an e-liquid container unless the e-liquid container constitutes child-resistant packaging.

     (b)  Any person convicted of violating this section shall be subject to section 328J-12.

     (c)  For purposes of this section:

     "Child-resistant packaging" means packaging that meets the specifications set forth in title 16 Code of Federal Regulations section 1700.15(b), and is tested by the method described in title 16 Code of Federal Regulations section 1700.20.

     "E-liquid" shall have the same meaning as in section 245-1.

     "E-liquid container" means a bottle or other container of e-liquid.  "E-liquid container" does not include a container holding liquid that is intended for use in an electronic smoking device if the container is pre-filled and sealed by the manufacturer and is not intended to be opened by the consumer."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:
