A BILL FOR AN ACT

 

 

relating to workplace violence.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§78-    Workplace violence; public agencies; mandatory reporting.  (a)  As used in this section:

     "Public agency" means any office, department, board, commission, bureau, division, public corporation, agency, or instrumentality of the state or county government.

     "Workplace violence" means any act or threat of physical violence, harassment, intimidation, or other threatening or disruptive behavior that occurs at a work site, ranging from threats and verbal abuse to physical assaults and even homicide.

     (b)  Any employee of a public agency who witnesses an incident of workplace violence shall report that act to the employee's immediate supervisor or to a law enforcement agency of the State or applicable county.

     (c)  Any employee who fails to report an incident of workplace violence pursuant to subsection (b) shall be guilty of a petty misdemeanor and shall be fined not less than:

     (1)  $1,000 for a first offense; and

     (2)  $2,000 for any subsequent offense."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
