A BILL FOR AN ACT

 

 

proposing an AMENDMENT to article vi, section 2, of the hawaii constitution to authorize the temporary assignment of circuit court judges to the district court.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article VI, section 2, of the Constitution of the State of Hawaii, to authorize the chief justice to assign a circuit judge to serve temporarily on the district court.

     SECTION 2.  Article VI, section 2, of the Constitution of the State of Hawaii is amended to read as follows:

     "SUPREME COURT; INTERMEDIATE APPELLATE COURT; CIRCUIT

     Section 2.  The supreme court shall consist of a chief justice and four associate justices.  The chief justice may assign a judge or judges of the intermediate appellate court or a circuit court to serve temporarily on the supreme court, a judge of the circuit court to serve temporarily on the intermediate appellate court or on the district court, and a judge of the district court to serve temporarily on the circuit court.  As provided by law, at the request of the chief justice, retired justices of the supreme court also may serve temporarily on the supreme court, and retired judges of the intermediate appellate court, the circuit courts, the district courts and the district family courts may serve temporarily on the intermediate appellate court, on any circuit court, on any district court and on any district family court, respectively.  In case of a vacancy in the office of chief justice, or if the chief justice is ill, absent or otherwise unable to serve, an associate justice designated in accordance with the rules of the supreme court shall serve temporarily in place of the chief justice."

    SECTION 3.  The question to be printed on the ballot shall be as follows:

    "Shall the chief justice have the authority to assign a judge of the circuit court to temporarily serve on the district court?"

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
