A BILL FOR AN ACT

 

 

relating to education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that there is no consistent age restriction for general education and special education students under Hawaii law.  For general education pupils, section 302A-1134(c), Hawaii Revised Statutes, prohibits students eighteen years or older from entering the tenth grade, but is silent with regard to age limits for the twelfth grade.  For special education students, the State is allowed to deviate from the requirements of the Individuals with Disabilities Education Act only if there is a clear state law that sets age limits.

     The legislature finds that Hawaii must abide by the Individuals with Disabilities Education Act's mandated provision of special education programs for students aged eighteen through twenty-one.  Under existing law, there is no consistent age limit provision for general education and special education students.

     The purpose of this Act is to provide consistent age limits for both general education and special education students.

     SECTION 2.  Section 302A-1134, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  No child who is seventeen years of age or over shall be admitted to the ninth grade of a public four-year high school[, and]; no child who is eighteen years of age or over shall be admitted to the tenth grade of a public [senior] four‑year high school[,]; no child who is nineteen years of age or over shall be admitted to the eleventh grade of a public four‑year high school; and no child who is twenty years of age or over shall be admitted to the twelfth grade of a public four‑year high school, except upon the written permission of the superintendent when in the superintendent's opinion the facts warrant admission."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
