A BILL FOR AN ACT

 

 

RELATING TO AN OFFICE OF THE HOUSING ADVOCATE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to title 13 to be appropriately designated and to read as follows:

"Chapter

HOUSING ADVOCATE

     §   ‑1  Office of the housing advocate; qualifications; duties.  (a)  There is established the office of the housing advocate, to be placed within the office of the governor for administrative purposes only.  The office shall be headed by the housing advocate and funded by the general fund.  The governor shall appoint, without regard to chapter 76, the housing advocate to serve a term of four years, concurrent with the term of the governor; provided that if a vacancy occurs within the four-year term, the governor shall appoint a replacement for the remainder of the term.  This appointment shall not be subject to senate confirmation.

     (b)  The housing advocate shall carry out the objectives and policies for socio-cultural advancement as it relates to housing, as set forth in section 229-19, including the policy to effectively accommodate the housing needs of Hawaii's people, and the following:

     (1)  Identifying promising special and functional needs, affordable and market stand-alone housing, and mixed-use and master planned projects in each county;

     (2)  Facilitating projects through state government departments and processes;

     (3)  Identifying state and local regulatory barriers to the development of housing; and

     (4)  Making recommendations regarding policies, laws, and rules, including taxation, land use, and financing, to remove barriers to the development of housing."

     SECTION 2.  One full-time equivalent (1.0 FTE) position within the office of the governor shall be transferred to the office of the housing advocate to establish one full-time equivalent (1.0 FTE) position of the housing advocate.


     SECTION 3.  This Act shall take effect on July 1, 2022.
