A BILL FOR AN ACT

 

 

Relating to solid Waste.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that rainwater that enters dumpster bins results in pollution and impairment of the efficiency of the State's waste management programs.  The mixing of the contents of a dumpster and rainwater can cause pressing problems, including the possible spillage of trash and water polluted by grease, bacteria, chemicals, and other such contaminants on and into Hawaii's grounds, aquifers, storm drains, and ocean.  Furthermore, trash saturated with rainwater is heavier and thus costlier to transport, and this same garbage also inhibits the efficiency of incinerators such as those at H-Power which turn waste into energy.  Although private and state dumpsters are sometimes covered, there is no overarching policy mandating the covering of dumpster bins.

     The purpose of this Act is to require all dumpster bins or other containers used to store solid waste to be sheltered or protected from rainwater by a roof, cover, or lid.

     SECTION 2.  Section 342H-30, Hawaii Revised Statutes, is amended to read as follows:

     "§342H-30  Prohibition; civil.  (a)  No person, including any public body, shall engage in the operation of an open dump.

     (b)  No person, including any public body, shall operate a solid waste management system without first securing approval in writing from the director.

     (c)  No person, including any public body, shall discard, dispose of, deposit, discharge, or dump solid waste, or by contract or otherwise arrange directly or indirectly for the disposal of solid waste in an amount equal to or greater than one cubic yard in volume anywhere other than a permitted solid waste management system without the prior written approval of the director.  Each day of violation shall constitute a separate offense.  This prohibition shall not be deemed to supersede any other disposal prohibitions established under federal, state, or county law, regulation, rule, or ordinance.

     (d)  No person, including any public body, shall maintain on the person's premises a dumpster bin, or any other container used to store solid waste, that is not sheltered or protected from rainwater by a roof, cover, or lid."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2013.
