A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328-    Customized patient medication package.  (a)  A pharmacy may provide a customized patient medication package to any patient of an institutional facility or any member of the general public; provided that:

     (1)  The pharmacy has obtained the written or verbal consent of the patient, patient's caregiver, patient's guardian, or prescribing practitioner; and

     (2)  The written consent is accompanied with the patient's current prescription and meets the requirements of section 328-16, United States Pharmacopeia standards, and National Formulary standards.

     (b)  As used in this section:

     "Customized patient medication package" means a package that is prepared by a pharmacist for a specific patient and that contains one or more prescribed solid oral dosage forms.

     "Institutional facility" has the same meaning as in section 461-1.

     "Pharmacist" has the same meaning as "registered pharmacist" in section 461-1.

     "Pharmacy" has the same meaning as in section 461-1."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
