A BILL FOR AN ACT

 

 

RELATING TO INTOXICATING LIQUOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 281-22, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  A commission employee may support, advocate, or aid in the election or defeat of any candidate for public office, or run for public office[; provided the employee:

     (1)  Notifies the commission in writing of the employee's intent to support, advocate, or aid in the election or defeat of a candidate for public office; and

     (2)  If a candidate for public office, takes a leave of absence in accordance with section 78-23 for a period beginning prior to the initiation of political activities related to the candidacy and ending the day following the general election for the office]."

     SECTION 2.  Section 281-101, Hawaii Revised Statutes, is amended to read as follows:

     §281-101  Manufacture or sale without license; penalty.  If any person, acting in person or by or through any agent, servant, or employee, manufactures or sells any liquor, either directly or indirectly, or upon any pretense or by any subterfuge, except as authorized pursuant to this chapter, the person shall be fined not more than [$2,000] $5,000 or imprisoned not more than one year, or both."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.

Report Title:

Liquor Commission Employees; Political Activities; Unlicensed Manufacturing or Selling of Liquor

 

Description:

Deletes the requirements that a liquor commission employee notify the commission of intent to support, advocate, or aid in the election or defeat of any candidate for public office and take a leave of absence if the employee is a candidate for public office.  Raises the monetary fine for manufacturing or selling liquor without a license.
