A BILL FOR AN ACT

 

 

RELATING TO CYBERSECURITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that implementing effective cybersecurity measures is a challenge faced by all states.  The legislature also finds that coordinating the resources of the department of defense, the University of Hawaii, and the office of information technology will help to create educational programs to improve cybersecurity in the State and develop responses to cyber-attacks.

     The purpose of this Act is to establish the Hawaii cybersecurity, economic, education, and infrastructure security council to recommend improvements to the State's cybersecurity and to develop methods for securing federal moneys to fund other cybersecurity improvements.

     SECTION 2.  (a)  There is established the Hawaii cybersecurity, economic, education, and infrastructure security council within the office of information technology for administrative purposes.

     (b)  The council shall be composed of the following six members or their designees:

     (1)  The chief information officer, who shall serve as the chair;

     (2)  The director of business, economic development, and tourism;

     (3)  The adjutant general;

     (4)  The chair of the University of Hawaii department of information and computer sciences;

     (5)  A member of a private institution of higher learning with knowledge of cybersecurity to be selected by the chief information officer; and

     (6)  The vice president for military affairs of the chamber of commerce of Hawaii.

     (c)  The members of the council shall serve without compensation and shall not be reimbursed for expenses incurred in the performance of their duties.

     (d)  The council shall:

     (1)  Meet at least quarterly; and

     (2)  Develop methods for:

          (A)  Improving the State's cybersecurity by using existing resources;

         (B)  Improving the State's cybersecurity operations through partnerships with private businesses, government, and institutions of higher education;

          (C)  Examining specific actions to accelerate the growth of cybersecurity as an industry in the State;

         (D)  Securing federal moneys for cybersecurity activities and related educational programs; and

         (E)  Partnering with the United States Pacific Command and other military organizations to implement infrastructure protection and redundancies and to prevent cyber-attacks, warfare, and terrorism.

     (e)  The council may request the assistance of other departments to carry out its duties.

     (f)  The council shall submit a report of its findings, recommendations, and proposed legislation to the legislature, no later than twenty days prior to the convening of the regular session of 2015.

     (g)  For the purposes of this Act, "council" shall mean the Hawaii cybersecurity, economic, education, and infrastructure security council.

     SECTION 3.  This Act shall take effect on July 1, 2014; provided that the council shall be dissolved on June 30, 2016.
