A BILL FOR AN ACT

 

 

relating to CONSERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 180C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§180C-    Change in use of land; conservation plan void.  (a)  A conservation plan that is approved by the applicable soil and water conservation district shall be void if there is a subsequent change in the use of the land that is not consistent with the use approved in the conservation plan.  The plan shall be deemed void as of the date of the change in the use of the land.

     (b)  Any exemptions from ordinances that were obtained based upon a conservation plan that is void pursuant to subsection (a) shall be void as of the date of the change in the use of the land, or the effective date of this Act, whichever occurs later, and the land use shall be subject to any ordinances enacted pursuant to section 180C-2."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2010.
