A BILL FOR AN ACT

 

 

relating to health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that heavy ion cancer therapy is an innovative new cancer treatment that is more precise and has higher success rates than other cancer treatments.  The legislature recognizes that heavy ion cancer therapy is available in several locations throughout the world, including Taiwan, but waitlists for the treatment are extensive.  The legislature believes that, because cancer patients are willing to incur the significant cost of this treatment, offering heavy ion cancer therapy in the State could significantly increase the State's revenues and subsidize the treatment for resident cancer patients.

     Accordingly, the purpose of this Act is to require the department of health to conduct a study to determine the feasibility of establishing a heavy ion cancer therapy center in the State and using revenues derived from non-resident use of the therapy center to subsidize residents' cancer treatments.

     SECTION 2.  (a)  The department of health shall conduct a study to determine the cost and feasibility of establishing a heavy ion cancer therapy center in the State and directing that revenues derived from treating non-residents at the therapy center subsidize cancer treatment for residents of the State.

     (b)  The department of health may contract with a third party to conduct the study required by subsection (a).

     (c)  The department of health shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     SECTION 3.  This Act shall take effect upon its approval.
