A BILL FOR AN ACT

 

 

RELATING TO HISTORIC PRESERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that comprehensive statewide inventories of historic properties and burial sites are critical to managing and protecting historic properties and grave sites in Hawaii.  The department of land and natural resources state historic preservation division has the responsibility of creating and maintaining inventories, but such activities remain an unfunded mandate.  For surveying and inventory, the state historic preservation division relies on documentation submitted in support of project reviews and knowledgeable individuals who contribute new information to existing databases and inventories.  As a portion of historic buildings and burial sites are located in restricted or undeveloped areas of the State, the collected data does not represent accurate, comprehensive information.

     The legislature further finds that the absence of comprehensive statewide inventories delays project planning, as developers, planners, and state and county agencies lack key information on the location of historic properties and burial sites.  The missing data can impact planning processes at points when significant resources have already been expended, causing projects to be redesigned or delayed.  Conflict within communities regarding proposed projects and the potential impact on historic properties or burial sites has also delayed projects.

     In addition, the state historic preservation division experiences difficulties in meeting its historic property and burial site responsibilities as the division lacks key information on locations.  In some instances, the state historic preservation division does not obtain knowledge of historic properties or burial sites until the permit application.

     Therefore, the purpose of this Act is to appropriate funding to the department of land and natural resources state historic preservation division to expedite development of a comprehensive, complete inventory of historic properties and burial sites located across the State and to conduct relevant archaeological surveys necessary to provide further information for the inventory.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the development of a comprehensive inventory of historic properties and burial sites; provided that the sum shall be expended as follows:

     (1)  $           for a state-of-the-art archaeological surface survey integrating the use of remote sensing, aerial, and satellite imagery;

     (2)  $           for data collection on the location of burial sites; and

     (3)  $           for conduction of an inventory on historic buildings, structures, and other properties.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2050.
