A BILL FOR AN ACT

 

 

relating to collective bargaining.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Various state agencies have investigators who perform a wide range of investigative services, but not all of them perform the functions and have the authorities of the state law enforcement officers.  The investigators of the criminal investigation division, narcotics enforcement division, office of homeland security division, office of the inspector general division, and sheriff division of the department of law enforcement are given additional powers, authority, benefits, and privileges of a police officer or of a deputy sheriff, including the power of arrest.  The legislature recognizes that these investigators are subject to the law enforcement standards of chapter 139, Hawaii Revised Statutes.  It is the intent of the legislature to ensure that these investigators are included in the appropriate collective bargaining unit for state law enforcement officers.

     Accordingly, the purpose of this Act is to transfer the investigators of the criminal investigation division, narcotics enforcement division, office of homeland security division, office of the inspector general division, and sheriff division of the department of law enforcement who are subject to the law enforcement standards of chapter 139, Hawaii Revised Statutes, from collective bargaining unit (13) into collective bargaining unit (14).

     SECTION 2.  Section 89-6, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  All employees throughout the State within any of the following categories shall constitute an appropriate bargaining unit:

     (1)  Nonsupervisory employees in blue collar positions;

     (2)  Supervisory employees in blue collar positions;

     (3)  Nonsupervisory employees in white collar positions;

     (4)  Supervisory employees in white collar positions;

     (5)  Teachers and other personnel of the department of education under the same pay schedule, including part-time employees working less than twenty hours a week who are equal to one-half of a full-time equivalent;

     (6)  Educational officers and other personnel of the department of education under the same pay schedule;

     (7)  Faculty of the [University] university of Hawaii and the community college system;

     (8)  Personnel of the [University] university of Hawaii and the community college system, other than faculty;

     (9)  Registered professional nurses;

    (10)  Institutional, health, and correctional workers;

    (11)  Firefighters;

    (12)  Police officers;

    (13)  Professional and scientific employees, who cannot be included in any of the other bargaining units;

    (14)  State law enforcement officers[;] including investigators of the criminal investigation division, narcotics enforcement division, office of homeland security division, office of the inspector general division, and sheriff division of the department of law enforcement; and

    (15)  State and county ocean safety and water safety officers."

     SECTION 3.  All rights, benefits, and privileges currently enjoyed by investigators of the criminal investigation division, narcotics enforcement division, office of homeland security division, office of the inspector general division, and sheriff division of the department of law enforcement, including those rights, benefits, and privileges under chapters 76, 78, 87A, and 88, Hawaii Revised Statutes, shall not be impaired or diminished as a result of these employees being transitioned to bargaining unit (14).  The transition to bargaining unit (14) shall not result in any break in service for the affected employees.  All rights, benefits, and privileges currently enjoyed by investigators of the criminal investigation division, narcotics enforcement division, office of homeland security division, office of the inspector general division, and sheriff division of the department of law enforcement shall be maintained under their existing collective bargaining agreement and any successor agreement until a new collective bargaining agreement is negotiated for bargaining unit (14).

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2024.
