A BILL FOR AN ACT

 

 

relating to firearms.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 134, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§134-    Defense.  It is a defense to prosecution under sections 134-23 to 134-27 that the person possessed, displayed or used a firearm in justifiable use of force in self-protection or in justifiable use of force for the protection of another person during the commission of a crime in which that person or the other person protected was a victim."

     SECTION 2.  This act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
