A BILL FOR AN ACT

 

 

relating to the Criminal justice system.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to title 20 to be appropriately designated and to read as follows:

"Chapter

CRIMINAL JUSTICE ASSESSMENT COMMISSION

     §    -1  Criminal justice assessment commission established; duties.  (a)  There is established the criminal justice assessment commission, hereinafter referred to as the commission, to be attached administratively to the department of public safety. 

     (b)  The commission shall:

     (1)  Develop a strategic master plan to increase the integration and collaboration of the various state and county criminal justice entities for the purposes of:

          (A)  Reducing correctional facility overcrowding;

          (B)  Reducing recidivism;

          (C)  Improving and expanding mental health and substance abuse treatment;

          (D)  Reducing barriers to community integration of former inmates; and

          (E)  Implementing the recommendations of other criminal justice task forces and commissions;

     (2)  Gather and analyze relevant criminal justice-related statistics and information and make the information available to the governor and the legislature; and

     (3)  Recommend methods to maximize the benefit of relevant grants and other available funds from the federal government, including grants from the Substance Abuse and Mental Health Services Administration of the United States Department of Health and Human Services.

     §    -2  Composition; expenses.  (a)  The criminal justice assessment commission shall consist of the following members:

     (1)  The director of public safety or the director's designee;

     (2)  The attorney general or the attorney general's designee;

     (3)  The director of health or the director's designee;

     (4)  The director of human services or the director's designee;

     (5)  The director of labor and industrial relations or the director's designee;

     (6)  The administrator of the office of Hawaiian affairs or the administrator's designee;

     (7)  A representative of the county departments of the prosecuting attorney to be selected by the prosecuting attorneys;

     (8)  The state public defender or the public defender's designee;

     (9)  The chairperson of the Hawaii paroling authority or the chairperson's designee;

    (10)  One senator who shall be appointed by the president of the senate;

    (11)  One representative who shall be appointed the speaker of the house of representatives;

    (12)  One judge who shall be appointed by the chief justice;

    (13)  One adult probation administrator who shall be appointed by the chief justice;

    (14)  One member from the private sector who is knowledgeable on issues pertaining to reintegrating offenders into the community who shall be appointed by the governor;

    (15)  One member from the public who is knowledgeable on issues relating to the criminal justice system and has substantial experience or expertise in traditional Native Hawaiian practices who shall be appointed by the governor; and

    (16)  One rehabilitated offender, who is knowledgeable on issues pertaining to reintegrating offenders into the community, who shall be invited by the chairperson of the Hawaii paroling authority.

     (b)  The members of the commission shall serve without compensation but shall be reimbursed for expenses necessary in the performance of their duties.  The members appointed or invited to serve on the commission pursuant to paragraphs (a)(14), (15), and (16) shall not be subject to section 26-34; provided that each member appointed or invited pursuant to those paragraphs shall serve not more than two consecutive four-year terms.

     (c)  The governor shall appoint the chairperson of the commission from among its members.

     §    -3  Meetings.  The commission shall meet not less than once in 2019, 2020, and every two-year period starting January 1, 2021.

     §    -4  Reports.  Twenty days prior to the legislative sessions of 2020, 2021, and each odd numbered year starting in 2023, the commission shall submit a report to the legislature on its activities, including its most recent strategic master plan, recommendations, and proposed legislation, if any."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 purposes of this Act.

     The sums appropriated shall be expended by the department of public safety for the purposes of this Act.

     SECTION 3.  This Act shall take effect upon its approval; provided that section 2 of this Act shall take effect on July 1, 2019.
