A BILL FOR AN ACT


 

 

RELATING TO STATE VETERANS' HOME.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 323F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§323F‑    Veterans' gift account.  (a)  The veterans' gift account is established within the state treasury.  Except as otherwise provided in subsection (b), gifts of personal property that the chief executive officer of the corporation is authorized to receive for the use of the state veterans' gift may be:

     (1)  Sold or exchanged; or

     (2)  Used in-kind if the gifts are not appropriate for conversion to money.

     (b)  The veterans' gift account shall be administered by the chief executive officer of the corporation.  Gifts of money or personal property authorized to be accepted by the chief executive officer shall be:

     (1)  If applicable, used only in the manner authorized by the donor; and

     (2)  Deposited with the director of finance for credit to the veterans' gift account.

     The interest and income earned on the money in the veterans' gift account, after deducting any applicable charges, shall be credited to the veterans' gift account.  No money remaining in the veterans' gift account at the end of each fiscal year shall lapse to the state general fund, but shall be carried forward into the next fiscal year.

     (c)  The veterans' gift account shall be subject to section 37‑47."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
