A BILL FOR AN ACT

 

 

relating to the public lands development corporation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 55 of 2011 established the public lands development corporation as a State development corporation attached to the Department of Land and Natural Resources to develop public lands placed under the public lands development corporation jurisdiction, including but not limited to existing open shoreline areas, conservation lands, agricultural lands, and small boat harbors, for commercial purposes.  Act 55 of 2011 has allowed the public lands development corporation to exempt development projects from regular oversight. The public lands development corporation has over-arching powers to make economic, environmental, and social use of Hawaii’s public lands.  The legislature finds that its action in empowering the public lands development corporation to exempt development projects from laws that require review of substantial environment, ecological, and cumulative impacts of development in the affected area was in error.  Additionally, Act 55 of 2011 has placed burdens upon the residents of this State that are unnecessary and overly burdensome.

     SECTION 2.  Act 55 of 2011 is repealed.

     SECTION 3.  This Act shall take effect upon its approval.
