A BILL FOR AN ACT

 

 

RELATING TO agricultural lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§141-     Department lands; pet animal sanctuaries; permitted use.  (a)  Notwithstanding any other law to the contrary, lands under the jurisdiction of the department of agriculture may be leased or used for pet animal sanctuaries; provided that the department of agriculture determines that the pet animal sanctuary provides a public benefit.

     (b)  The following uses shall not be considered to provide a public benefit pursuant to subsection (a):

     (1)  The use of a pet animal for any type of entertainment, recreational, or commercial purpose, including zoos;

     (2)  The sale, trade, lending, or barter of a pet animal or the pet animal's body parts; or

     (3)  The breeding of a pet animal.

     (c)  As used in this section:

     "Lands under the jurisdiction of the department of agriculture" include:

     (1)  Agricultural enterprise lands pursuant to chapter 141D;

     (2)  Agricultural parks pursuant to chapter 166;

     (3)  Non-agricultural park lands pursuant to chapter 166E;

     (4)  Lands owned or controlled by the agribusiness development corporation; and

     (5)  Any other lands owned or controlled by the department of agriculture and zoned for agricultural use.

     "Pet animal" has the same meaning as in section 711-1100.

     "Pet animal sanctuary" means a location that is used as a place of refuge where abused, neglected, unwanted, impounded, abandoned, orphaned, or displaced pet animals are rehabilitated or provided living space and care for their lifetime."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
