STATE OF HAWAII

A BILL FOR AN ACT

relating to emergency services.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

prescription medication safety law

§ -1 Long-acting opioid painkillers; other opioid painkillers; emergency rooms. (a) No physician, advanced practice registered nurse with prescriptive authority pursuant to section 457-8.6, or physician assistant, in providing emergency services at any hospital in the State, shall prescribe any long-acting opioid painkillers, including but not limited to extended-release oxycodone, fentanyl patches, or methadone.

(b) No physician, advanced practice registered nurse with prescriptive authority pursuant to section 457-8.6, or physician assistant, in providing emergency services at any hospital in the State, shall prescribe more than a seven-day supply of any other opioid painkillers.

§ -2 Prescription refills; emergency rooms. Pursuant to section 329-28(a)(3), no physician, advanced practice registered nurse with prescriptive authority pursuant to section 457-8.6, or physician assistant, in providing emergency services at any hospital in the State, shall refill any prescription for opioid painkillers.

§ -3 Exemptions. (a) This chapter shall not apply to emergency room treatment of:

(1) Any serious illness, disease, or condition such as cancer; or

(2) Any other illness, disease, or condition that requires palliative care.

(b) This chapter shall not apply to prescriptions made outside of an emergency room.

§ -4 Penalties. Any person who violates this chapter shall be fined not more than $500, or imprisoned not more than one year, or both."

SECTION 2. This Act shall take effect upon its approval.

Provides exceptions. Establishes penalties.
