A BILL FOR AN ACT

 

 

relating to appropriations made out of the emergency and budget reserve fund pursuant to act 191, session laws of hawaii 2010.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Pursuant to Act 191, Session Laws of Hawaii 2010, the legislature appropriated moneys from the emergency and budget reserve fund to maintain levels of essential programs for education, human services, health, and the public welfare.  As of December 2010, the new governor is in the process of releasing the funds appropriated pursuant to Act 191.  However, due to the delay in the release of funds the expending agencies may not have enough time to expend the funds before they lapse at the end of the 2010-2011 fiscal year, thereby severely curtailing their ability to help the persons recognized by the legislature as being in dire need of these essential services.

     The purpose of this Act is to extend to December 31, 2011 the date on which the funds will lapse to ensure the fulfillment of the legislature's intent in passing Act 191, Session Laws of Hawaii 2010.

     SECTION 2.  Act 191, Session Laws of Hawaii 2010, is amended as follows:

     1.  By amending section 12 to read:

     "SECTION 12.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $332,000 or so much thereof as may be necessary for fiscal year 2010-2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Waianae District Comprehensive Health and Hospital Board, Incorporated to support its emergency room services.

     The sum appropriated shall be expended by the department of health for the purposes of this Act."

     2.  By amending section 16 to read:

     "SECTION 16.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $500,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Kokua Kalihi Valley Comprehensive Family Services.

     The sum appropriated shall be expended by the department of health for the purposes of this Act."

     3.  By amending section 17 to read:

     "SECTION 17.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $600,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Medical Service Association for Keiki Care.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     4.  By amending section 18 to read:

     "SECTION 18.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Windward Oahu Spouse Abuse Shelter.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     5.  By amending section 19 to read:

     "SECTION 19.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Blueprint for Change Program for Neighborhood Place Walk-in Centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     6.  By amending section 21 to read:

     "SECTION 21.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $762,500 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to support domestic violence shelters statewide[.] and to be distributed as follows:

     (1)  Child and Family Service                       

          (A)  Two shelters on Oahu               $206,429

          (B)  Two shelters on Big Island         $206,429

     (2)  Parents and Children Together           $103,214

     (3)  Women Helping Women                     $103,214

     (4)  Hale Hoomalu                             $40,000

     (5)  Young Women's Christian

          Association of Kauai                    $103,214

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     7.  By amending section 22 to read:

     "SECTION 22.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $210,000 for fiscal year 2010-2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hale Mahaolu for personal care services.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     8.  By amending section 30 to read:

     "SECTION 30.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Adult Friends for Youth for youth gang prevention and intervention services.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act."

     9.  By amending section 32 to read:

     "SECTION 32.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Volunteer Legal Services Hawaii to provide pro bono legal services for indigent persons.

     The sum appropriated shall be expended by the judiciary for the purposes of this Act."

     10.  By amending section 33 to read:

     "SECTION 33.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $720,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Legal Aid Society of Hawaii to provide general civil legal services.

     The sum appropriated shall be expended by the judiciary for the purposes of this Act."

     11.  By amending section 34 to read:

     "SECTION 34.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $282,000 or so much thereof as may be necessary for fiscal year 2010‑2011 for the University of Hawaii Family Law Clinic to provide services to obtain temporary restraining orders.

     The sum appropriated shall be expended by the judiciary for the purposes of this Act."

     12.  By amending section 35 to read:

     "SECTION 35.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Catholic Charities Hawaii to provide intra-familial sex assault services.

     The sum appropriated shall be expended by the judiciary for the purposes of this Act."

     13.  By amending section 36 to read:

     "SECTION 36.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Children's Alliance of Hawaii, Incorporated to provide child sex assault services.

     The sum appropriated shall be expended by the judiciary for the purposes of this Act."

     14.  By amending section 38 to read:

     "SECTION 38.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $75,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the YMCA of Honolulu for the Weed and Seed Program.

     The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act."

     15.  By amending section 39 to read:

     "SECTION 39.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $466,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Kapiolani Medical Center for Women and Children for the sex abuse treatment center for statewide sex assault services.

     The sum appropriated shall be expended by the department of the attorney general for the purposes of this Act."

     16.  By amending section 40 to read:

     "SECTION 40.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $300,000 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Families for R.E.A.L. program.

     The sum appropriated shall be expended by the department of education for the purposes of this Act."

     17.  By amending section 41 to read:

     "SECTION 41.  This Act shall take effect on July 1, 2010[.]; provided that the appropriations made by this Act shall not lapse at the end of the fiscal year for which the appropriations are made; provided further that moneys from the appropriations made by this Act that are unencumbered as of December 31, 2011, shall lapse at the close of business on that date."

     SECTION 3.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $60,000 or so much thereof as may be necessary for fiscal year 2010-2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to The Path Clinic for perinatal clinical and social services for women in Hawaii with past or present substance abuse.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $447,750 or so much thereof as may be necessary for fiscal year 2010‑2011 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hawaii Centers for Independent Living for the statewide independent living purchase of services.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 5.  The appropriations made by sections 3 and 4 of this Act shall not lapse at the end of the fiscal year for which the appropriations are made; provided that moneys from the appropriations made by sections 3 and 4 of this Act that are unencumbered as of December 31, 2011, shall lapse at the close of business on that date.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect upon its approval.
