SENATE CONCURRENT

RESOLUTION

 

 

AUTHORIZING THE ISSUANCE OF A TERM, NON-EXCLUSIVE EASEMENT COVERING A PORTION OF STATE SUBMERGED LANDS AT SAND ISLAND, HONOLULU, OAHU, FOR THE USE, MAINTENANCE, IMPROVEMENT, AND REPLACEMENT OF THE EXISTING FLOATING DOCK.

 

 


     WHEREAS, the existing floating dock fronting the property identified as Tax Map Key: (1)1-5-041: portions of 006, Sand Island, Oahu, is located upon state submerged lands; and

 

     WHEREAS, the Marine Educational Training Center, an educational facility operated by Honolulu Community College that provides training programs for the repair and maintenance of marine vessels and engines, is currently using the floating dock for educational and research purposes; and

 

     WHEREAS, additional users include the University of Hawaii Sailing Team, the University of Hawaii Student Recreation Services, and the Polynesian Voyaging Society; and

 

     WHEREAS, due to the closure of the University of Hawaii Marine Center at Pier 45 Snug Harbor Facility, the University of Hawaii School of Ocean and Earth Science and Technology will divide and relocate its small-boat operations to the proposed School of Ocean and Earth Science and Technology and Marine Educational Training Center facilities at Sand Island; and

 

     WHEREAS, the current site at Sand Island will require improvements that include installing a new, larger floating dock to replace the existing floating dock fronting the Marine Educational Training Center in order to accommodate the spacing needs of the School of Ocean and Earth Science and Technology; and

 

     WHEREAS, on September 25, 2015, under agenda item D-12, the Board of Land and Natural Resources approved a grant of a sixty-five-year lease to the University of Hawaii for educational purposes over the adjoining parcels, which lease also includes a non-exclusive easement to resolve the encroachment of the floating dock upon state submerged lands; and

 

     WHEREAS, the subject area is about 64,602 square feet, which will be reviewed and approved by the Department of Accounting and General Services' Survey Division; and

 

     WHEREAS, section 171-53, Hawaii Revised Statutes, requires the prior approval of the Governor and prior authorization of the Legislature by concurrent resolution to lease state submerged lands; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, the House of Representatives concurring, that the Board of Land and Natural Resources is hereby authorized to issue a term, non-exclusive easement covering a portion of state submerged lands fronting the property identified as Tax Map Key: (1)1-5-041: portions of 006, Sand Island, Honolulu, Oahu, for the use, maintenance, improvement, and replacement of the existing floating dock, pursuant to section 171-53, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the President of the University of Hawaii System and the Chairperson of the Board of Land and Natural Resources.
