subsection
10,
paragraph
c,

is
amended
to
read
as
follows:

c.
If
the
pupil
meets
the
economic
eligibility
requirements
3
established
by
the
department
and
state
board
of
education,
the
4
sending
district
is
responsible
for
providing
transportation
5
or
paying
the
pro
rata
cost
of
the
transportation
to
a
parent
6
or
guardian
for
transporting
the
pupil
to
and
from
a
point
on
7
a
regular
school
bus
route
of
a
contiguous
receiving
district
8
that
is
contiguous
to
the
sending
district,
or
is
located
in
9
a
county
that
is
contiguous
to
the
sending
district,
unless
10
the
cost
of
providing
transportation
or
the
pro
rata
cost
of
11
the
transportation
to
a
parent
or
guardian
exceeds
the
average
12
transportation
cost
per
pupil
transported
for
the
previous
13
school
year
in
the
district.
If
the
cost
exceeds
the
average
14
transportation
cost
per
pupil
transported
for
the
previous
15
school
year,
the
sending
district
shall
only
be
responsible
16
for
that
average
per
pupil
amount.
A
sending
district
which
17
provides
transportation
for
a
pupil
to
a
contiguous
receiving
18
district
under
this
subsection
may
withhold,
from
the
district
19
cost
per
pupil
amount
that
is
to
be
paid
to
the
receiving
20
district,
an
amount
which
represents
the
average
or
pro
rata
21
cost
per
pupil
for
transportation,
whichever
is
less.

EXPLANATION
23
This
bill
expands
the
responsibilities
of
a
sending
24
school
district
for
transporting
or
paying
for
the
costs
of
25
transporting
pupils
participating
in
open
enrollment
who
meet
26
the
economic
eligibility
requirements
established
by
the
state
27
board
of
education
and
the
department
of
education.
Currently,
28
the
sending
district’s
responsibilities
are
only
to
transport
29
or
pay
for
such
students
who
open
enroll
to
a
contiguous
school
30
district.
The
bill
makes
the
sending
district
responsible
for
31
such
students
who
open
enroll
to
a
district
that
is
contiguous
32
to
the
sending
district
or
is
located
in
a
county
that
is
33
contiguous
to
the
sending
district.
