NEW SECTION . 483A.6A Paddlefish fishing license and 9 tag. 10 1. A resident fishing for paddlefish on the Missouri or 11 Big Sioux river who is required to have a fishing license 12 must purchase a paddlefish fishing license, in addition to a 13 resident fishing license. 14 2. A nonresident fishing for paddlefish on the Missouri 15 or Big Sioux river is required to have a fishing license that 16 is valid in Iowa and, in addition, purchase a nonresident 17 paddlefish fishing license. 18 3. The commission shall establish the number of annual 19 paddlefish fishing licenses that may be issued pursuant to 20 section 481A.39 for use on the Missouri or Big Sioux river. 21 A paddlefish fishing license shall be accompanied by a tag 22 designed to be used only once. If a paddlefish is taken 23 pursuant to a paddlefish fishing license, the paddlefish shall 24 be tagged immediately and the tag shall be dated. 25 Sec. 4. Section 483A.24, subsection 6, Code 2014, is amended 26 to read as follows: 27 6. A resident or nonresident of the state under sixteen 28 years of age is not required to have a license to fish in the 29 waters of the state. However, residents and nonresidents under 30 sixteen years of age must pay the trout fishing fee to possess 31 trout or they must fish for trout with a licensed adult who has 32 paid the trout fishing fee and limit their combined catch to 33 the daily limit established by the commission. Section 805.8B, subsection 3, paragraph c, Code 3 2014, is amended to read as follows: 4 c. For violations of sections 481A.6 , 481A.21 , 481A.22 , 5 481A.26 , 481A.50 , 481A.56 , 481A.60 through 481A.62 , 481A.83 , 6 481A.84 , 481A.92 , 481A.123 , 481A.145, subsection 3 , sections 7 483A.6A, 483A.7 , 483A.8 , 483A.23 , 483A.24 , and 483A.28 , the 8 scheduled fine is twenty-five dollars. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill authorizes the natural resource commission to 13 issue paddlefish fishing licenses for use on the Missouri 14 and Big Sioux rivers pursuant to the commission’s powers to 15 maintain biological balance pursuant to Code section 481A.39. 16 The license must be accompanied by a tag designed to be used 17 only once. If a paddlefish is taken pursuant to the license, 18 the paddlefish shall be tagged and the tag dated. 19 A resident fishing for paddlefish on the Missouri or Big 20 Sioux river who is required to have a fishing license must 21 have a resident fishing license and also purchase an annual 22 paddlefish fishing license that costs $20. 23 A nonresident fishing for paddlefish on the Missouri or Big 24 Sioux river must have a fishing license that is valid in Iowa 25 and also purchase an annual paddlefish fishing license that 26 costs $40. 27 A resident or nonresident of the state under 16 years of age 28 is not required to have a fishing license to fish in the waters 29 of the state but is required to have a paddlefish fishing 30 license to fish for paddlefish on the Missouri or Big Sioux 31 river. 32 A violation of the bill’s requirements is punishable by a 33 scheduled fine of $25. In addition, a person who illegally 34 takes a paddlefish must reimburse the state for the value of 35 -2- LSB 5544HV (1) 85 da/nh 2/ 3
