H.F. 2564 Section 1. NEW SECTION . 148J.1 Definitions. 1 For the purposes of this chapter: 2 1. “Board” means the board of medicine established pursuant 3 to chapter 147. 4 2. “Health care facility” means all of the following: 5 a. A facility as defined in section 514J.102. 6 b. A facility licensed pursuant to chapter 135B. 7 c. A facility licensed pursuant to chapter 135C. 8 3. “International medical program” means a medical school, 9 residency program, medical internship program, or entity that 10 provides physicians with a medical education or training 11 outside of the United States that is substantially similar to 12 the practice of medicine and surgery or osteopathic medicine 13 and surgery in Iowa and that has been evaluated by the 14 educational commission on foreign medical graduates. 15 4. “International physician” means an individual who meets 16 all of the following requirements: 17 a. Has a medical doctorate or substantially similar degree 18 issued by an international medical program in good standing. 19 b. Has been in good standing with the medical licensing or 20 regulatory institution of the individual’s resident country 21 during the immediately preceding five years and has no pending 22 discipline before the licensing or regulatory institution. 23 c. Has completed a residency or substantially similar 24 postgraduate medical training in the individual’s resident 25 country. 26 d. Has practiced medicine and surgery or osteopathic 27 medicine and surgery as a licensed physician for five years 28 following the completion of a residency or substantially 29 similar postgraduate medical training. 30 e. Possesses basic fluency in the English language. 31 Sec. 2. NEW SECTION . 148J.2 International physicians —— 32 provisional licenses. 33 1. a. The board shall grant a provisional license to 34 practice medicine and surgery or osteopathic medicine and 35 -1- LSB 6091YH (4) 90 ss/ko 1/ 4
H.F. 2564 surgery in this state to an international physician with an 1 offer for employment as a physician at a health care facility 2 in this state. However, the board shall not grant a license 3 pursuant to this subsection to an international physician who 4 does not possess a federal immigration status allowing the 5 international medical graduate to practice as a physician 6 in the United States, or to an international physician who 7 fails to obtain a passing score on the United States medical 8 licensing examination. 9 b. A provisional license granted pursuant to paragraph “a” 10 shall be converted to a full license to practice medicine and 11 surgery or osteopathic medicine and surgery after three years, 12 unless the license has been revoked pursuant to subsection 2 13 or surrendered by the licensee. 14 2. a. The board may revoke a provisional license granted 15 pursuant to subsection 1, paragraph “a” , if the board finds by 16 clear and compelling evidence that the licensee has violated 17 a provision of section 148.6. A licensee may appeal a 18 revocation pursuant to this subsection in a court of competent 19 jurisdiction within one hundred twenty days of the date of 20 revocation. 21 b. The board may revoke a provisional license granted 22 pursuant to subsection 1, paragraph “a” , if the international 23 physician is not employed by a health care facility in this 24 state during the entirety of the provisional licensing period. 25 3. This section does not require the board to grant a 26 provisional license or full license pursuant to subsection 1 to 27 an individual that does not do all of the following: 28 a. Complete training substantially similar to a physician 29 and surgeon or osteopathic physician and surgeon. 30 b. Receive a passing score on the United States medical 31 licensing examination. 32 c. Pass a background check as required by the board. 33 d. Complete a licensure application as required by the 34 board. 35 -2- LSB 6091YH (4) 90 ss/ko 2/ 4
H.F. 2564 e. Pay all required fees as required by the board. 1 Sec. 3. EFFECTIVE DATE. This Act takes effect January 1, 2 2025. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill relates to the licensure of international 7 physicians in Iowa. The bill defines “international physician” 8 as a person who holds a medical doctorate or substantially 9 similar degree issued by an international medical program, has 10 been in good standing with the medical regulatory body of the 11 person’s country of residence for the immediately preceding 12 five years and has no pending discipline, has completed a 13 residency or similar postgraduate education program, has 14 practiced medicine and surgery or osteopathic medicine and 15 surgery as a licensed physician for five years following the 16 completion of a residency or substantially similar postgraduate 17 medical training and has a basic fluency in English. The bill 18 defines “international medical program” as a medical training 19 program or entity that provides physicians with a medical 20 education or training, outside of the United States that is 21 substantially similar to the practice of medicine and surgery 22 or osteopathic medicine and surgery in Iowa and that has been 23 evaluated by the educational commission on foreign medical 24 graduates. 25 The bill requires the board of medicine to issue a 26 provisional license to practice medicine and surgery or 27 osteopathic medicine and surgery in Iowa to an international 28 physician who has received a passing score on the United States 29 medical licensing examination and has an offer for employment 30 as a physician with a health care facility, as defined in 31 the bill, in this state. The board may revoke a provisional 32 license if the board finds by clear and compelling evidence 33 that the licensee has engaged in conduct for which a licensee 34 in medicine and surgery or osteopathic medicine and surgery 35 -3- LSB 6091YH (4) 90 ss/ko 3/ 4
H.F. 2564 may be disciplined, or if the licensee is not employed by a 1 health care facility in this state during the entirety of 2 the provisional licensing period. If a provisional license 3 is not revoked or surrendered, the provisional license shall 4 be converted to a full license after three years. The bill 5 allows the board to conduct a background check and require the 6 submission of an application and application fee. 7 The bill takes effect January 1, 2025. 8 -4- LSB 6091YH (4) 90 ss/ko 4/ 4
