  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 724.22, Code 2015, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  2A.  If a person violates subsection 1 or 2
  1  4 by selling, loaning, giving, or making available a weapon or
  1  5 ammunition described in subsection 1 or 2, to a minor, and the
  1  6 minor subsequently commits a public offense with that weapon or
  1  7 ammunition, the person commits a class "D" felony.
  1  8                           EXPLANATION
  1  9 The inclusion of this explanation does not constitute agreement with
  1 10 the explanation's substance by the members of the general assembly.
  1 11    This bill relates to providing weapons or ammunition to
  1 12 minors.
  1 13    The bill provides that a person who violates Code section
  1 14 724.22(1) or (2) by selling, loaning, giving, or making
  1 15 available a weapon (rifle, shotgun, pistol, or revolver) or
  1 16 ammunition as described in Code section 724.22(1) or (2), to
  1 17 a minor, and the minor subsequently commits a public offense
  1 18 with that weapon or ammunition, the person commits a class "D"
  1 19 felony. Under current law, if a person sells, loans, gives,
  1 20 or makes available a weapon or ammunition described in Code
  1 21 section 724.22(1) or (2), to a minor, the person commits a
  1 22 serious misdemeanor for a first offense and a class "D" felony
  1 23 for any second and subsequent offense.
  1 24    A class "D" felony is punishable by confinement for no more
  1 25 than five years and a fine of at least $750 but not more than
  1 26 $7,500.
