  1  1    Section 1.  NEW SECTION.  514C.31  Preventive services ==
  1  2 coverage.
  1  3    1.  Notwithstanding the uniformity of treatment requirements
  1  4 of section 514C.6, an individual or group policy, contract,
  1  5 or plan providing for third=party payment or prepayment
  1  6 of health or medical expenses shall provide coverage for
  1  7 preventive services as specified in section 2713 of the
  1  8 federal Patient Protection and Affordable Care Act, Pub. L. No.
  1  9 111=148, without the imposition of copayments, deductibles, or
  1 10 co=insurance on patients receiving these services.
  1 11    2.  The provisions of this section shall apply to all of the
  1 12 following classes of third=party payment provider policies,
  1 13 contracts, or plans delivered, issued for delivery, continued,
  1 14 or renewed in this state:
  1 15    a.  Individual or group accident and sickness insurance
  1 16 providing coverage on an expense=incurred basis.
  1 17    b.  An individual or group hospital or medical service
  1 18 contract issued pursuant to chapter 509, 514, or 514A.
  1 19    c.  An individual or group health maintenance organization
  1 20 contract regulated under chapter 514B.
  1 21    d.  An individual or group Medicare supplemental policy,
  1 22 unless coverage pursuant to such policy is preempted by federal
  1 23 law.
  1 24    e.  A plan established pursuant to chapter 509A for public
  1 25 employees.
  1 26    3.  This section shall not apply to accident=only, specified
  1 27 disease, short=term hospital or medical, hospital confinement
  1 28 indemnity, credit, dental, vision, long=term care, basic
  1 29 hospital, and medical=surgical expense coverage as defined
  1 30 by the commissioner, disability income insurance coverage,
  1 31 coverage issued as a supplement to liability insurance,
  1 32 workers' compensation or similar insurance, or automobile
  1 33 medical payment insurance.
  1 34    4.  The commissioner of insurance shall adopt rules pursuant
  1 35 to chapter 17A as necessary to administer this section.
  2  1    Sec. 2.  CONTINGENT IMPLEMENTATION.  The implementation of
  2  2 this Act is contingent upon the repeal of the federal Patient
  2  3 Protection and Affordable Care Act, Pub. L. No. 111=148, in
  2  4 a manner that does not replace the coverage for preventive
  2  5 services as specified in section 2713 of the of the federal
  2  6 Patient Protection and Affordable Care Act, Pub. L. No.
  2  7 111=148, without the imposition of copayments, deductibles,
  2  8 or co=insurance on patients receiving these services.  The
  2  9 commissioner of insurance shall notify the Iowa Code editor of
  2 10 the effective date of such repeal.
  2 11    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  2 12 immediate importance, takes effect upon enactment.
  2 13    Sec. 4.  APPLICABILITY.  This Act applies to third=party
  2 14 payment provider policies, contracts, and plans, as specified
  2 15 in section 514C.31, as enacted in this Act, that are delivered,
  2 16 issued for delivery, continued, or renewed in this state on
  2 17 or after  the effective date of the repeal of the federal
  2 18 Patient Protection and Affordable Care Act, Pub. L. No.
  2 19 111=148, in a manner that does not replace the coverage
  2 20 for preventive services as specified in section 2713 of the
  2 21 federal Patient Protection and Affordable Care Act, Pub. L. No.
  2 22 111=148, without the imposition of copayments, deductibles, or
  2 23 co=insurance on patients receiving these services as specified
  2 24 by the commissioner of insurance in the notification of the
  2 25 Iowa Code editor of such repeal.
  2 26                           EXPLANATION
  2 27 The inclusion of this explanation does not constitute agreement with
  2 28 the explanation's substance by the members of the general assembly.
  2 29    This bill provides that an individual or group policy,
  2 30 contract, or plan providing for third=party payment or
  2 31 prepayment of health or medical expenses shall provide coverage
  2 32 for preventive services as specified in section 2713 of the
  2 33 federal Patient Protection and Affordable Care Act, without
  2 34 the imposition of copayments, deductibles, or co=insurance on
  2 35 patients receiving these services. The bill specifies the
  3  1 classes of third=party payment provider policies, contracts, or
  3  2 plans delivered, issued for delivery, continued, or renewed in
  3  3 this state to which the requirement is and is not applicable
  3  4 and requires the commissioner of insurance to adopt rules to
  3  5 administer the bill.
  3  6     The bill takes effect upon enactment but implementation
  3  7 of the bill is contingent upon the repeal of the federal
  3  8 Patient Protection and Affordable Care Act in a manner that
  3  9 does not replace the coverage for preventive services  without
  3 10 the imposition of copayments, deductibles, or co=insurance
  3 11 on patients receiving these services.  The commissioner of
  3 12 insurance shall notify the Iowa Code editor of the effective
  3 13 date of such repeal.
  3 14    The bill is applicable to third=party payment provider
  3 15 policies, contracts, and plans that are delivered, issued for
  3 16 delivery, continued, or renewed in this state on or after  the
  3 17 effective date of the repeal of the federal Patient Protection
  3 18 and Affordable Care Act in a manner that does not replace the
  3 19 coverage for preventive services without the imposition of
  3 20 copayments, deductibles, or co=insurance on patients receiving
  3 21 these services, as specified by the commissioner of insurance
  3 22 in the notification of the Iowa Code editor of such repeal.
