S.F. 2005 Section 1. NEW SECTION . 280.13D Interscholastic athletic 1 activities —— schools in border states. 2 1. a. If a school district or nonpublic school located in 3 a county that borders another state cannot form a team for an 4 interscholastic athletic activity because not enough students 5 have registered to participate, the board of directors of the 6 school district or the authorities in charge of the nonpublic 7 school may complete an agreement with a non-Iowa public school 8 or nonpublic school that borders the county in which the school 9 district or nonpublic school is located to provide for the 10 eligibility of the non-Iowa students in the interscholastic 11 athletic activity provided by the school district or nonpublic 12 school. 13 b. A school district or a nonpublic school shall file a 14 copy of each agreement completed under this subsection with the 15 appropriate organization, as organization is defined in section 16 280.13, not later than April 30 of the school year preceding 17 the school year in which the agreement takes effect, unless 18 an exception is granted by the organization for good cause. 19 An agreement completed under this subsection shall be deemed 20 approved unless denied by the organization within ten days 21 after receipt. An agreement denied by the organization under 22 this subsection may be appealed to the state board of education 23 under chapter 290. 24 2. The board of directors of a school district located in a 25 county that borders another state or the authorities in charge 26 of a nonpublic school located in a county that borders another 27 state may complete an agreement with a non-Iowa public school 28 or nonpublic school that borders the county in which the school 29 district or nonpublic school is located to provide for the 30 eligibility of the Iowa school district’s or nonpublic school’s 31 students in interscholastic athletic activities provided by 32 the non-Iowa public school or nonpublic school if the Iowa 33 public school or nonpublic school cannot form a team for an 34 interscholastic athletic activity because not enough students 35 -1- LSB 5111XS (4) 90 jda/jh 1/ 3
S.F. 2005 have registered to participate. 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 This bill relates to the eligibility of students enrolled 5 in public schools or nonpublic schools in border states 6 or in counties that border another state to compete in 7 interscholastic athletic activities provided by public schools 8 or nonpublic schools in the other state. 9 The bill provides that if a school district or a nonpublic 10 school located in a county that borders another state cannot 11 form a team for an interscholastic athletic activity because 12 not enough students have registered to participate, the school 13 district or the nonpublic school may complete an agreement 14 with a non-Iowa public school or nonpublic school that borders 15 the county in which the school district or nonpublic school 16 is located to provide for the eligibility of the non-Iowa 17 students in interscholastic athletic activities provided by 18 the school district or nonpublic school. The bill requires 19 school districts and nonpublic schools to file a copy of 20 such agreement with the appropriate organization, as defined 21 in Code section 280.13 (requirements for interscholastic 22 athletic contests and competitions), not later than April 30 23 of the school year preceding the school year in which the 24 agreement takes effect, unless an exception is granted by 25 the organization for good cause. The bill provides that an 26 agreement completed under these provisions shall be deemed 27 approved unless denied by the organization within 10 days after 28 receipt.
