5.
APPLICABILITY.
This
Act
applies
to
school
districts
7
that
materially
breach
an
agreement
created
pursuant
to
section
8
280.13A
with
an
accredited
nonpublic
school
prior
to
the
9
expiration
of
the
agreement,
without
good
cause,
and
without
10
mutual
agreement
of
all
parties
to
the
agreement
prior
to
11
materially
breaching
the
agreement
on
or
after
the
effective
12
date
of
this
Act.

Sec.
6.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
14
importance,
takes
effect
upon
enactment.

EXPLANATION
16
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
funding
calculations
for
the
teacher
19
salary
supplement,
professional
development
supplement,
early
20
intervention
supplement,
and
teacher
leadership
supplement
for
21
school
districts
that
materially
breach
an
interscholastic
22
sharing
agreement.
23
For
the
purposes
of
funding
the
teacher
salary
supplement,
24
professional
development
supplement,
early
intervention
25
supplement,
and
teacher
leadership
supplement,
school
26
districts
are
allowed
to
count
resident
students
who
receive
an
27
education
savings
account
payment
(ESA
students)
in
the
funding
28
calculation.

The
bill
prohibits
a
school
district
from
counting
ESA
30
students
in
its
funding
calculations
for
the
teacher
salary
31
supplement,
professional
development
supplement,
early
32
intervention
supplement,
and
teacher
leadership
supplement
if
33
the
school
district
has
materially
breached
an
interscholastic
34
sharing
agreement
with
an
accredited
nonpublic
school
prior

without

and

agreement

the
parties
that
entered
into
the

bill
applies

districts
that

Code

280.13A
with
an

accredited
nonpublic
school
prior
to
the
expiration
of
the

agreement,
without
good
cause,
and
without
mutual

of

parties
to
the
agreement
prior

breaking
the
agreement
on

or
after
the
effective
date
of
the
bill.
