S.F. 2081 Section 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES 1 WAIVERS —— EXCEPTION TO POLICY PROVISIONS. The department 2 of human services shall adopt rules pursuant to chapter 17A 3 specifying that an individual who is a recipient of home and 4 community-based services waiver services based on an exception 5 to policy shall continue to be eligible for and receive the 6 services granted through the exception to policy request 7 beyond the period specified in the exception to policy, if, 8 at the time of review of the exception to policy and in lieu 9 of submitting a new request, the individual’s primary health 10 care provider submits a confirmation to the department of human 11 services stating that there is little or no probability that 12 the individual’s status upon which the existing exception to 13 policy was granted will significantly change in the period 14 until the next review. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill directs the department of human services to adopt 19 rules specifying that an individual who is a recipient of 20 home and community-based services waiver services based on 21 an exception to policy shall continue to be eligible for and 22 receive the services granted through the exception to policy 23 request beyond the period specified in the exception to policy, 24 if, at the time of review of the exception to policy and in lieu 25 of submitting a new request, the individual’s primary health 26 care provider submits a confirmation to the department of human 27 services stating that there is little or no probability that 28 the individual’s status upon which the existing exception to 29 policy was granted will significantly change in the period 30 until the next review. 31 -1- LSB 5323XS (5) 85 pf/nh 1/ 1
