includes

device
which

temporarily

motor
vehicle,
unless
the
device

message”
means
a
self-contained

piece
of
digital
communication
that
is
designed
or
intended

or
be
transmitted
by
electronic
means.
“Electronic
message”

includes
but
is
not
limited
to
a
text-based
message,
an
instant

message,
and
electronic
mail
an
electronic
mail
message,
and
a

communication
designed
to
initiate
access
to
an
internet
site
.

The
terms
“write”
“compose”
,
“send”
,
and
“read”
,
with

respect
to
a

electronic
message,
mean
the
manual
entry,

transmission,
and
retrieval
of
a

electronic
message,

communicate
with

person
or
device.

person

not
use

violate

system

the

engaging
in
a
call,
the
person
selects
or
enters
a

telephone
number
or
name
in
a
hand-held
mobile
telephone
or

activates,
deactivates,
or
initiates
a
function
of
a
hand-held

mobile
telephone.

b.
The
provisions
of
this
subsection
relating
to
reading

text
an
electronic
message
do
not
apply
to
the
following

persons:

(1)
A
member
of
a
public
safety
agency,
as
defined
in

performing
official
duties.

A
health
care
professional
in
the
course
of
an
emergency

situation.

A
person
receiving
safety-related
information
including

emergency,
traffic,
or
weather
alerts.
