Senate File 2343 - Introduced SENATE FILE BY COMMITTEE ON JUDICIARY (SUCCESSOR TO SF 284) A BILL FOR 1 An Act allowing law enforcement agencies to retain possession 2 of motor vehicles suspected to have been used to elude law 3 enforcement vehicles. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 2387SV (3) 87 ns/rh PAG LIN 1 1 Section 1. Section 321.279, Code 2018, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 4. Notwithstanding any other provision 1 4 of law to the contrary, a law enforcement agency may retain 1 5 possession of a motor vehicle suspected to have been 1 6 operated by a person in violation of this section until final 1 7 disposition of any criminal proceeding related to the violation 1 8 if the person was a registered owner of the vehicle at the time 1 9 of the suspected violation. 1 10 EXPLANATION 1 11 The inclusion of this explanation does not constitute agreement with 1 12 the explanation's substance by the members of the general assembly. 1 13 This bill permits a law enforcement agency to retain 1 14 possession of a vehicle suspected to have been operated by a 1 15 person eluding or attempting to elude a law enforcement vehicle 1 16 until final disposition of any criminal proceeding related 1 17 to the violation if the person was a registered owner of the 1 18 vehicle at the time of the suspected violation.
