S.F. 282 Section 1. Section 70A.1, subsection 1, Code 2023, is 1 amended to read as follows: 2 1. a. Salaries specifically provided for in an 3 appropriation Act of the general assembly shall be in lieu of 4 existing statutory salaries, for the positions provided for in 5 the Act, and all salaries, including longevity where applicable 6 by express provision in the Code, shall be paid according to 7 the provisions of chapter 91A and shall be in full compensation 8 of all services, including any service on committees, boards, 9 commissions or similar duty for Iowa government, except for 10 members of the general assembly. A state employee on an annual 11 salary shall not be paid for a pay period an amount which 12 exceeds the employee’s annual salary transposed into a rate 13 applicable to the pay period by dividing the annual salary by 14 the number of pay periods in the fiscal year. 15 b. Salaries for state employees covered by the overtime 16 payment provisions of the federal Fair Labor Standards Act 17 shall be established on an hourly basis. For purposes of 18 calculating overtime payment for such employees, all of the 19 following shall be counted as hours worked: 20 (1) Paid sick leave when used before forty hours in pay 21 status are accumulated or if prescheduled at least sixteen 22 hours in advance. 23 (2) Paid leave for court appearances, voting, jury duty, 24 travel between job sites, and holidays, including unscheduled 25 holidays. 26 (3) Paid annual leave or compensatory leave. 27 (4) Other paid time off. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill provides that specified forms of paid leave shall 32 be counted as hours worked for purposes of calculating overtime 33 payment for state employees covered by the overtime payment 34 provisions of the federal Fair Labor Standards Act. 35 -1- LSB 1994XS (4) 90 je/rn 1/ 1
