Senate File 337 - Introduced SENATE FILE BY BERTRAND A BILL FOR 1 An Act relating to residency requirements for institutions of 2 higher learning governed by the state board of regents. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1976XS (2) 87 kh/sc PAG LIN 1 1 Section 1. Section 262.9, subsection 17, Code 2017, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. c. Adopt rules establishing that for an 1 4 individual to be classified as a resident for purposes of 1 5 in=state tuition and mandatory fees, the individual, except as 1 6 otherwise provided under this subsection, shall have resided in 1 7 this state for at least thirty consecutive months immediately 1 8 prior to enrollment in an institution of higher learning 1 9 governed by the board. 1 10 EXPLANATION 1 11 The inclusion of this explanation does not constitute agreement with 1 12 the explanation's substance by the members of the general assembly. 1 13 This bill directs the state board of regents to adopt rules 1 14 to establish that for an individual to be classified as a 1 15 resident for purposes of in=state tuition and mandatory fees, 1 16 the individual must have resided in Iowa for 30 consecutive 1 17 months immediately prior to their enrollment in a regents 1 18 university. 1 19 Currently, the board may, at its discretion, adopt rules 1 20 relating to the residency of students, for fee purposes, who 1 21 are also residents of Iowa's sister states. The board is 1 22 directed to adopt rules to classify as residents, for purposes 1 23 of undergraduate tuition and mandatory fees, qualified veterans 1 24 and qualified military persons and their spouses and dependent 1 25 children who are domiciled in this state while enrolled in a 1 26 regents university. These current statutory provisions are 1 27 exempted from the residency requirement established by the 1 28 bill. LSB 1976XS (2) 87 kh/sc
