Coverage
of
religious
or

spiritually
based
health
care.

1.
Notwithstanding
the
uniformity
of
treatment
requirements
3
of
section
514C.6,
a
policy
or
contract,
or
plan
established
4
pursuant
to
chapter
509A,
providing
for
third-party
payment
or
5
prepayment
of
health
or
medical
expenses
shall
not
discriminate
6
in
approving
or
covering
a
health
or
medical
care
service
on
7
the
basis
of
its
religious
or
spiritual
content
if
expenditures
8
for
such
a
health
or
medical
care
service
are
eligible
for
9
deduction
as
a
health
or
medical
care
expense
as
determined
by
10
internal
revenue
service
rulings
interpreting
section
213(d)
of
11
the
Internal
Revenue
Code
of
1986
in
effect
on
January
1,
2011.

2.
This
section
shall
not
apply
to
accident-only,
13
specified
disease,
short-term
hospital
or
medical,
hospital
14
confinement
indemnity,
credit,
dental,
vision,
Medicare
15
supplement,
long-term
care,
basic
hospital
and
medical-surgical
16
expense
coverage
as
defined
by
the
commissioner,
disability
17
income
insurance
coverage,
coverage
issued
as
a
supplement
18
to
liability
insurance,
workers’
compensation
or
similar
19
insurance,
or
automobile
medical
payment
insurance.

2.
APPLICABILITY.
This
Act
applies
to
a
third-party
21
payment
provider
policy
or
contract,
or
plan
established
22
pursuant
to
chapter
509A,
that
is
delivered,
issued
for
23
delivery,
continued,
or
renewed
in
this
state
on
or
after
24
January
1,
2012.

EXPLANATION
26
This
bill
creates
new
Code
section
514C.29
which
prohibits
27
any
policies,
contracts,
or
plans
providing
for
third-party
28
payment
or
prepayment
of
health
or
medical
care
expenses
from
29
discriminating
in
approving
or
covering
a
health
or
medical
30
care
service
on
the
basis
of
its
religious
or
spiritual
31
content
if
the
service
is
eligible
for
deduction
as
a
health
or
32
medical
care
expense
as
determined
by
rulings
of
the
internal
33
revenue
service
interpreting
section
213(d)
of
the
Internal
34
Revenue
Code
of
1986
in
effect
on
January
1,
2011.
