1 | AMENDMENT TO HOUSE BILL 440

2 | AMENDMENT NO. ______. Amend House Bill 440 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Department of Insurance Law of the
Civil | ||||||
5 | Administrative Code of Illinois is amended by adding Section | ||||||
6 | 1405-50 as follows:
| ||||||
7 | (20 ILCS 1405/1405-50 new) | ||||||
8 | Sec. 1405-50. Consumer Health Care Access Liaison. The | ||||||
9 | Governor, with the advice and consent of the Senate, shall | ||||||
10 | appoint a person within the Department of Insurance to serve | ||||||
11 | as the Consumer Health Care Access Liaison for the State of | ||||||
12 | Illinois. The Consumer Health Care Access Liaison shall | ||||||
13 | receive an annual salary as set by the Governor and beginning | ||||||
14 | July 1, 2023 shall be compensated from appropriations made for | ||||||
15 | this purpose. The person appointed to serve as Consumer Health | ||||||
16 | Care Access Liaison may be an existing employee with other |

1 | duties. The Consumer Health Care Access Liaison shall have | ||||||
2 | authority to oversee and direct functions at other State | ||||||
3 | agencies related to network adequacy issues in Illinois, | ||||||
4 | including, but not limited to, the Department of Public | ||||||
5 | Health, the Department of Financial and Professional | ||||||
6 | Regulation, and the Department of Healthcare and Family | ||||||
7 | Services.

8 | Section 10. The Network Adequacy and Transparency Act is | ||||||
9 | amended by changing Section 30 as follows:

| ||||||
11 | Sec. 30. Administration and enforcement.
| ||||||
12 | (a) Insurers, as defined in this Act, have a continuing | ||||||
13 | obligation to comply with the requirements of this Act. Other | ||||||
14 | than the duties specifically created in this Act, nothing in | ||||||
15 | this Act is intended to preclude, prevent, or require the | ||||||
16 | adoption, modification, or termination of any utilization | ||||||
17 | management, quality management, or claims processing | ||||||
18 | methodologies of an insurer. | ||||||
19 | (b) Nothing in this Act precludes, prevents, or requires | ||||||
20 | the adoption, modification, or termination of any network plan | ||||||
21 | term, benefit, coverage or eligibility provision, or payment | ||||||
22 | methodology. | ||||||
23 | (c) The Director shall enforce the provisions of this Act | ||||||
24 | pursuant to the enforcement powers granted to it by law. |

1 | (d) The Department shall adopt rules to enforce compliance | ||||||
2 | with this Act to the extent necessary. | ||||||
3 | (e) The Consumer Health Care Access Liaison shall enforce | ||||||
4 | the provisions of this Act pursuant to Section 1405-50 of the | ||||||
5 | Department of Insurance Law.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.".
