| 1 | AMENDMENT TO HOUSE BILL 4480 | ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 4480 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Controlled Substances Act is | ||||||
| 5 | amended by adding Section 314.6 as follows:
| ||||||
| 6 | (720 ILCS 570/314.6 new) | ||||||
| 7 | Sec. 314.6. Patient records; release and report. | ||||||
| 8 | (a) A pharmacy shall inform a patient if the pharmacy | ||||||
| 9 | releases the patient's records to any person or entity without | ||||||
| 10 | the patient's written consent. | ||||||
| 11 | (b) A pharmacy shall create and publish an annual report | ||||||
| 12 | containing the number of patient information requests, | ||||||
| 13 | including subpoenas and warrants, that the pharmacy received | ||||||
| 14 | and how many of those requests the pharmacy fulfilled during | ||||||
| 15 | the preceding calendar year. The report shall be delivered to | ||||||
| 16 | the Department of Financial and Professional Regulation. | ||||||
