AMENDMENT TO SENATE BILL 1915
2 AMENDMENT NO. ______. Amend Senate Bill 1915 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by changing Sections
62605-25, 2605-40, and 2605-45 as follows:
7 (20 ILCS 2605/2605-25) (was 20 ILCS 2605/55a-1)
8 Sec. 2605-25. Department divisions.
9 (a) The Department is divided into the Illinois State
10Police Academy, the Office of the Statewide 9-1-1
11Administrator, and 4 divisions: the Division of Operations, the
12Division of Forensic Services, the Division of Justice Services
13Administration, and the Division of Internal Investigation.
14 (b) The Office of the Director shall:
15 (1) Exercise the rights, powers, and duties vested in
16 the Department by the Governor's Office of Management and

1 Budget Act.
2 (2) Exercise the rights, powers, and duties vested in
3 the Department by the Personnel Code.
4 (3) Exercise the rights, powers, and duties vested in
5 the Department by "An Act relating to internal auditing in
6 State government", approved August 11, 1967 (repealed; now
7 the Fiscal Control and Internal Auditing Act).

9 (20 ILCS 2605/2605-40) (was 20 ILCS 2605/55a-4)
10 Sec. 2605-40. Division of Forensic Services. The Division
11of Forensic Services shall exercise the following functions:
12 (1) (Blank). Exercise the rights, powers, and duties
13 vested by law in the Department by the Criminal
14 Identification Act.
15 (2) Exercise the rights, powers, and duties vested by
16 law in the Department by Section 2605-300 of this Law.
17 (3) Provide assistance to local law enforcement
18 agencies through training, management, and consultant
19 services.
20 (4) (Blank).
21 (5) Exercise other duties that may be assigned by the
22 Director in order to fulfill the responsibilities and
23 achieve the purposes of the Department.
24 (6) Establish and operate a forensic science
25 laboratory system, including a forensic toxicological

1 laboratory service, for the purpose of testing specimens
2 submitted by coroners and other law enforcement officers in
3 their efforts to determine whether alcohol, drugs, or
4 poisonous or other toxic substances have been involved in
5 deaths, accidents, or illness. Forensic toxicological
6 laboratories shall be established in Springfield, Chicago,
7 and elsewhere in the State as needed.
8 (6.5) Establish administrative rules in order to set
9 forth standardized requirements for the disclosure of
10 toxicology results and other relevant documents related to
11 a toxicological analysis. These administrative rules are
12 to be adopted to produce uniform and sufficient information
13 to allow a proper, well-informed determination of the
14 admissibility of toxicology evidence and to ensure that
15 this evidence is presented competently. These
16 administrative rules are designed to provide a minimum
17 standard for compliance of toxicology evidence and is not
18 intended to limit the production and discovery of material
19 information. These administrative rules shall be submitted
20 by the Department of State Police into the rulemaking
21 process under the Illinois Administrative Procedure Act on
22 or before June 30, 2017.
23 (7) Subject to specific appropriations made for these
24 purposes, establish and coordinate a system for providing
25 accurate and expedited forensic science and other
26 investigative and laboratory services to local law

1 enforcement agencies and local State's Attorneys in aid of
2 the investigation and trial of capital cases.

5 Sec. 2605-45. Division of Justice Services.
6Administration. The Division of Justice Services
7Administration shall exercise the following functions:
8 (1) (Blank). Exercise the rights, powers, and duties
9 vested in the Department by the Governor's Office of
10 Management and Budget Act.
11 (2) Pursue research and the publication of studies
12 pertaining to local law enforcement activities.
13 (3) (Blank). Exercise the rights, powers, and duties
14 vested in the Department by the Personnel Code.
15 (4) Operate an electronic data processing and computer
16 center for the storage and retrieval of data pertaining to
17 criminal activity.
18 (5) Exercise the rights, powers, and duties vested in
19 the former Division of State Troopers by Section 17 of the
20 State Police Act.
21 (6) (Blank). Exercise the rights, powers, and duties
22 vested in the Department by "An Act relating to internal
23 auditing in State government", approved August 11, 1967
24 (repealed; now the Fiscal Control and Internal Auditing
25 Act, 30 ILCS 10/).

1 (6.5) Exercise the rights, powers, and duties vested in
2 the Department by the Firearm Owners Identification Card
3 Act.
4 (7) Exercise other duties that may be assigned by the
5 Director to fulfill the responsibilities and achieve the
6 purposes of the Department.
7 (8) Exercise the rights, powers, and duties vested by
8 law in the Department by the Criminal Identification Act.
