1 AN ACT concerning public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by changing
5Section 16-121 as follows:
6 (40 ILCS 5/16-121) (from Ch. 108 1/2, par. 16-121)
7 (Text of Section WITHOUT the changes made by P.A. 98-599,
8which has been held unconstitutional)
9 Sec. 16-121. Salary. "Salary": The actual compensation
10received by a teacher during any school year and recognized by
11the system in accordance with rules of the board. "Salary" does
12not include expense reimbursements, expense allowances, or
13fringe benefits unless included in a reportable flexible
14benefit plan. For purposes of this Section, "school year"
15includes the regular school term plus any additional period for
16which a teacher is compensated and such compensation is
17recognized by the rules of the board.

19 Section 99. Effective date. This Act takes effect upon
