AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Insurance Code is amended by adding
Section 143.19.3 as follows:
(215 ILCS 5/143.19.3 new)
Sec. 143.19.3. Prohibition of rate increase for persons
involved in emergency use of vehicles.
(a) No insurer authorized to transact or transacting
business in this State, or controlling or controlled by or
under common control by or with an insurer authorized to
transact or transacting business in this State, that sells a
personal policy of automobile insurance in this State shall
increase the policy premium, cancel the policy, or refuse to
renew the policy solely because the insured or any other person
who customarily operates an automobile covered by the policy
has had an accident while operating an automobile in response
to an emergency when the insured was responding to a call to
duty as a volunteer EMS provider, as defined in Section 1-220
of the Illinois Vehicle Code.
(b) The provisions of subsection (a) also apply to all
personal umbrella policies.
Section 99. Effective date. This Act takes effect upon
becoming law.
