Bill Title: Amends the State Police Act, the Counties Code, and the Illinois Municipal Code. Provides that an Illinois State Police officer, county sheriff, or municipal police officer may use a patrol vehicle to transport a sick or injured person if an ambulance or specialized emergency medical service vehicle is not available or on-scene, or a medical emergency exists. Exempts the Illinois State Police, county, or municipality and an Illinois State Police officer, county sheriff, or municipal police officer from liability for an act or omission in providing medical emergency transportation, unless the act or omission constitutes willful or wanton misconduct.

1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||||
4 | Section 1. This Act may be referred to as Courtney's Law.
| |||||||||||||||||||||||
5 | Section 5. The State Police Act is amended by adding | |||||||||||||||||||||||
6 | Section 50 as follows:
| |||||||||||||||||||||||
7 | (20 ILCS 2610/50 new) | |||||||||||||||||||||||
8 | Sec. 50. Medical emergency transportation. | |||||||||||||||||||||||
9 | (a) An Illinois State Police officer may use a patrol | |||||||||||||||||||||||
10 | vehicle to transport a sick or injured person if an ambulance | |||||||||||||||||||||||
11 | or specialized emergency medical service vehicle is not | |||||||||||||||||||||||
12 | available or on-scene, or a medical emergency exists. | |||||||||||||||||||||||
13 | (b) If an Illinois State Police officer transports a sick | |||||||||||||||||||||||
14 | or injured person under this Section, neither the Illinois | |||||||||||||||||||||||
15 | State Police nor an Illinois State Police officer shall be | |||||||||||||||||||||||
16 | liable as a result of the Illinois State Police officer's act | |||||||||||||||||||||||
17 | or omission in providing medical emergency transportation, | |||||||||||||||||||||||
18 | including any assistance related thereto, unless the act or | |||||||||||||||||||||||
19 | omission constitutes willful and wanton misconduct. | |||||||||||||||||||||||
20 | (c) As used in this Section: | |||||||||||||||||||||||
21 | "Ambulance" has the meaning defined in Section 3.85 of the | |||||||||||||||||||||||
22 | Emergency Medical Services (EMS) Systems Act. |

2 | medical attention for a sickness or injury and delay in | ||||||
3 | receiving that attention may endanger his or her life. | ||||||
4 | "Specialized emergency medical services vehicle" has the | ||||||
5 | meaning defined in Section 3.85 of the Emergency Medical | ||||||
6 | Services (EMS) Systems Act.

7 | Section 10. The Counties Code is amended by adding Section | ||||||
8 | 3-6041 as follows:
| ||||||
9 | (55 ILCS 5/3-6041 new) | ||||||
10 | Sec. 3-6041. Medical emergency transportation. | ||||||
11 | (a) A sheriff may use a patrol vehicle to transport a sick | ||||||
12 | or injured person if an ambulance or specialized emergency | ||||||
13 | medical service vehicle is not available or on-scene, or a | ||||||
14 | medical emergency exists. | ||||||
15 | (b) If a sheriff transports a sick or injured person under | ||||||
16 | this Section, neither the county nor a sheriff shall be liable | ||||||
17 | as a result of the sheriff's act or omission in providing | ||||||
18 | medical emergency transportation, including any assistance | ||||||
19 | related thereto, unless the act or omission constitutes | ||||||
20 | willful and wanton misconduct. | ||||||
21 | (c) As used in this Section: | ||||||
22 | "Ambulance" has the meaning defined in Section 3.85 of the | ||||||
23 | Emergency Medical Services (EMS) Systems Act. | ||||||

10 | (a) A municipal police officer may use a patrol vehicle to | ||||||
11 | transport a sick or injured person if an ambulance or | ||||||
12 | specialized emergency medical service vehicle is not available | ||||||
13 | or on-scene, or a medical emergency exists. | ||||||
14 | (b) If a municipal police officer transports a sick or | ||||||
15 | injured person under this Section, neither the municipality | ||||||
16 | nor a municipal police officer shall be liable as a result of | ||||||
17 | the municipal police officer's act or omission in providing | ||||||
18 | medical emergency transportation, including any assistance | ||||||
19 | related thereto, unless the act or omission constitutes | ||||||
