Bill Title: Amends the Criminal Code of 2012. Creates the offense of disorderly conduct in a school zone. Provides that a person commits the offense when he or she: (1) knowingly displays signs, engages in oral protest, education, or passing leaflets or handbills within 300 feet of school premises, from one hour prior to the start of the school day until one hour after the school day ends; or (2) knowingly approaches within 8 feet of an individual who is within 300 feet of school premises for purposes of displaying signs, engaging in oral protest, education, or passing leaflets or handbills, from one hour prior to the start of the school day until one hour after the school day ends. Provides that disorderly conduct in a school zone is a Class A misdemeanor. Defines "school". Contains a severability provision. Effective immediately.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Criminal Code of 2012 is amended by adding | ||||||||||||||||||||||||
5 | Section 26-8 as follows:
| ||||||||||||||||||||||||
6 | (720 ILCS 5/26-8 new) | ||||||||||||||||||||||||
7 | Sec. 26-8. Disorderly conduct in a school zone. | ||||||||||||||||||||||||
8 | (a) The General Assembly finds and declares that the State | ||||||||||||||||||||||||
9 | has a compelling interest in protecting the right of Illinois | ||||||||||||||||||||||||
10 | children to a peaceful educational environment that fosters | ||||||||||||||||||||||||
11 | their ability to learn free from harmful distraction during | ||||||||||||||||||||||||
12 | school hours. | ||||||||||||||||||||||||
13 | (b) For purposes of this Section, "school" means any | ||||||||||||||||||||||||
14 | public or private school operated in accordance with the | ||||||||||||||||||||||||
15 | School Code. | ||||||||||||||||||||||||
16 | (c) A person commits disorderly conduct in a school zone | ||||||||||||||||||||||||
17 | when he or she: | ||||||||||||||||||||||||
18 | (1) knowingly displays signs, engages in oral protest, | ||||||||||||||||||||||||
19 | education, or passing leaflets or handbills within 300 | ||||||||||||||||||||||||
20 | feet of school premises, from one hour prior to the start | ||||||||||||||||||||||||
21 | of the school day until one hour after the school day ends; | ||||||||||||||||||||||||
22 | or | ||||||||||||||||||||||||
23 | (2) knowingly approaches within 8 feet of an |

8 | Section 97. Severability. The provisions of this Act are | ||||||
9 | severable under Section 1.31 of the Statute on Statutes.

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.
